1. General Provisions
1.1. These Terms of Use (hereinafter the Terms) govern the use of the website and web platform fixy.ee (hereinafter the Platform), which is operated by Fixy Estonia OÜ (hereinafter the Administrator).
1.2. The Platform provides a technical environment for interaction between the following users:
Employer — a user who creates and publishes job orders;
Candidate — a user who offers and performs services based on job orders.
1.3. The Administrator is not a party to any agreements concluded between the Employer and the Candidate and does not act as an intermediary, representative, employer, or guarantor for either party.
1.4. By using the Platform, the user confirms that:
they are at least 18 years old;
they have full legal capacity;
they have read and fully agree to these Terms.
2. Registration and User Account
2.1. To use the Platform’s features, the user must create a user account and provide truthful and up-to-date information.
2.2. The user is fully responsible for the security of their login credentials and for all actions carried out through their user account.
2.3. The Administrator has the right to temporarily suspend or delete a user account in case of violation of these Terms or applicable legislation.
3. Role and Status of the Platform
3.1. The Platform provides only:
a technical environment for publishing job orders;
the ability for Candidates to respond to job orders;
communication tools between users;
access to features in accordance with an active subscription.
3.2. The Platform does not verify or guarantee:
the quality, deadlines, or results of services;
the reliability of users;
the fulfillment of agreements between the parties.
3.3. All agreements between the Employer and the Candidate are concluded directly, without the involvement of the Administrator.
4. Payments and Subscription
4.1. Use of the Platform is based on a paid subscription according to the selected package.
4.2. The subscription provides access to the Platform’s features but does not include payment for Candidate services.
4.3. All payments between the Employer and the Candidate are agreed upon and carried out outside the Platform.
4.4. The Administrator:
does not accept service fees;
does not manage or hold users’ funds;
does not participate in financial disputes.
4.5. Subscription fees are non-refundable, except in cases provided by law.
5. User Obligations
5.1. All users undertake to:
comply with the legislation of the European Union and their country of residence;
use the Platform in good faith;
provide truthful and accurate information.
5.2. The Candidate is independently responsible for:
the quality and outcome of services;
fulfillment of tax and other legal obligations;
possession of all required permits and licenses.
5.3. The Employer is solely responsible for the selection of the Candidate and the terms of cooperation.
6. Limitation of Liability
6.1. The Administrator is not liable for:
damages arising from interactions between the Employer and the Candidate;
non-performance or improper performance of agreements;
services that do not meet the Employer’s expectations.
6.2. The Platform is provided on an “as is” basis.
7. Personal Data Processing and GDPR
7.1. The Administrator processes personal data in accordance with:
Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR);
the Platform’s Privacy Policy.
7.2. Processed data may include:
name and contact details;
user account data;
technical data (IP address, cookies).
7.3. The user has the right to:
access, correct, and delete their data;
restrict the processing of data;
data portability;
withdraw consent at any time.
7.4. Personal data is not transferred to third parties, except as required by law.
8. Content and Communication
8.1. The user is fully responsible for all content published on the Platform.
8.2. The publication of the following is prohibited:
illegal or misleading content;
content that infringes the rights of third parties.
8.3. The Administrator has the right to remove content that violates these Terms.
9. Termination of Use
9.1. The user has the right to discontinue use of the Platform at any time.
9.2. The Administrator may restrict or terminate access to the Platform in the event of violations of these Terms or applicable law.
10. Amendments to the Terms
10.1. The Administrator has the right to amend these Terms at any time.
10.2. Amendments enter into force upon publication on the website.
11. Governing Law and Disputes
11.1. These Terms are governed by the laws of the Republic of Estonia.
11.2. All disputes shall be resolved in a competent court in accordance with applicable law.
